OPINION AND ORDER CONDITIONALLY APPROVING RULE 23 ACTION SETTLEMENT by Judge Claria Horn Boom on 5/28/2019. The Settlement Class defined in the Parties' Settlement Agreement is CONDITIONALLY CERTIFIED for settlement purposes. Plaintif f Tina Mitcham is APPOINTED as class representative. The Service Payment to Plaintiff Tina Mitcham of $7,000 is PRELIMINARILY APPROVED. David W. Garrison and Joshua A. Frank of Barrett Johnston Martin & Garrison, LLC are APPOINTED as Class Cou nsel for the Rule 23 Class. RG2 Claims Administration is APPOINTED as Settlement Administrator to administer the settlement in accordance with the Settlement Agreement. The proposed Notice Materials are CONDITIONALLY APPROVED. Notice to class member s shall proceed as set forth in the parties' settlement agreement pending resolution of the Attorneys' Award Issue. The Parties' Motion for Preliminary Approval of the Rule 23 Settlement, including the cy pres award to the Kentucky Equal Justice Center is CONDITIONALLY APPROVED. The Parties are hereby ORDERED to submit a joint brief on the issue of the reasonableness of attorneys' fees pursuant to Rule 23 no later than Monday, June 3, by 5:00 p.m. The briefing shall be no greater than five (5) pages in length. Upon a finding of reasonableness of Attorneys' Fees and Costs, the Court will preliminarily approve the Parties' Rule 23 Settlement and will schedule a Final Fairness Hearing at that time. cc: Counsel (MEJ)
