McKinley, Jr. On initial review of the second amended complaint pursuant to 28 U.S.C. § 1915A, IT IS ORDERED that the following claims shall proceed: the § 1983 Eighth Amendment failure -to- protect claim against Defendants Brown and Webb in their individual capacities for damages; the § 1983 Eighth Amendment failure-to-provide-medical-treatment claim against Defendant Hampton in her individual capacity for damages; and the sta te-law claims against all Defendants. IT IS FURTHER ORDERED that all other claims are DISMISSED pursuant to 28 U.S.C. § 1915A(b)(1) for failure to state a claim upon which relief may be granted and pursuant to § 1915A(b)(2) for seeking damages from Defendants immune from such relief. cc: Plaintiff, pro se; Defendants; General Counsel, Justice & Public Safety Cabinet (JLS) |
