McKinley, Jr. on 3/21/2024: The letter, motion, and notice for clarification filed by Plaintiff Archie Whalen #4 , #5 , and #6 is GRANTED IN PART as clarified in this Memorandum and Order. The motion by Plaintiff to change this civil action to a criminal action #4 , #5 , and #6 is DENIED. No later than 4/20/2024, Plaintiff must file his complaint on the proper form and attach the necessary summonses. The Clerk of Court is DIRECTED to send Plaintiff a 1983/Bivens Prisoner Packet. No later than 4/20/2024, Plaintiff must either pay the $405.00 filing fee or file an application to proceed without prepayment of fees and affidavit form along with a certified copy of his prison trust account statement for the six-month period preceding the filing of the petition. Should Plaintiff seek to proceed in forma pauperis in this action, the Clerk of Court is DIRECTED to send Plaintiff an application to proceed without prepayment of fees for his completion.
