IT IS FURTHER ORDERED that all of Plaintiff's claims against Dr. Tangilag in her official-capacity, except the one pertaining to a race-based c ustom, are DISMISSED pursuant to 28 U.S.C. § 1915A(b)(1) for failure to state a claim upon which relief may be granted. within 30 days from the entry date of this Order, Plaintiff may file a third amended complaint. K.S.P. Medical Department ((within both capacity)) terminated. cc: Plaintiff(pro se), Defendants (DJT)
