ORDER and REASONS - IT IS ORDERED that: (1) the Motion to Dismiss 27 is DENIED WITHOUT PREJUDICE as to Plaintiffs state law claims for false arrest and malicious prosecution; (2) the Motion to Dismiss is GRANTED as to Plaintiff's federal § ; 1983 claims for false arrest and malicious prosecution; (3) the Motion to Dismiss is GRANTED as to Plaintiff's Monell municipal liability claims arising from Plaintiff's § 1983 claims for false arrest and malicious prosecution; and ( 4) GNOFCU's Motion for Summary Judgement 12 is GRANTED and GNOFCU is DISMISSED WITH PREJUDICE as a party to the instant suit as stated within document.
