Filing 254 ORDER & REASONS re dft Genworth Life and Annuity Insurance Company's 101 Motion for Summary Judgment: for the reasons stated, Genworth has demonstrated that it is entitled to summary judgment dismissing pla's claims for breach of contrac t, breach of fiduciary duty, conversion, and a finding that Genworth is joint tortfeasor with Geller or Nelson. However, the Court will deny Genworth's motion with regard to the claims for tort and fraud. Moreover, based on Pla's allegation s, the Court finds that the doctrine of contra non valentum may apply and therefore will not dismiss Pla's claims on the basis of prescription. Accordingly, IT IS HEREBY ORDERED that Genworth's Motion for Summary Judgment isGRANTED IN PART and DENIED IN PART. IT IS FURTHER ORDERED that Pla's claims against Genworth for breach of contract, breach of fiduciary duty, conversion, and a finding that Genworth is a joint tortfeasor are DISMISSED; IT IS FURTHER ORDERED that the pending motion is DENIED with regard to Pla's claims against Genworth for tort and fraud.
