ORDER & REASONS that Defendant Sidney Bach's 11 Motion to Dismiss for Failure to State a Claim is GRANTED. KD Gretna's claims are DISMISSED WITHOUT PREJUDICE. KD Gretna has 14 days from the date of this Order to file an amended compla int. In light of this ruling, IT IS FURTHER ORDERED that KD Gretna's pending 26 Motion for Leave to File Verified First Amended and Supplemental Complaint is DENIED WITHOUT PREJUDICE.
