ORDER & REASONS: ORDERED that Defendant's Motion to Dismiss (Rec. Doc. 15 ) is GRANTED IN PART and DENIED IN PART as set forth in document. Plaintiff's claims against Defendant for the alleged negligence of the G.V. (Sonny) Montgomery V A Medical Center and its staff, agents, and employees, related to the surgery performed on October 6, 2011, are hereby DISMISSED with prejudice.
