ORDER AND REASONS granting in part Defendants' 104 Motion for Summary Judgment. Defendants are entitled to summary judgment on all of Plaintiff Seals's claims and on Plaintiff Bergeron's federal and state excessive force claims . Further, Sheriff Edwards is entitled to summary judgment on all of Plaintiffs' federal law claims. These claims are DISMISSED WITH PREJUDICE. Plaintiff Bergeron's federal false arrest and malicious prosecution claims remain. Additiona lly, Sheriff Edwards is entitled to summary judgment on all state law vicarious liability claims except those corresponding to Plaintiff Bergeron's remaining state law claims. Thus, Plaintiff Bergeron's state law vicarious liability claims against Sheriff Edwards based on false arrest and malicious prosecutions allegations survive.
