ORDER AND REASONS GRANTING IN PART AND DENYING IN PART 7 Motion to Dismiss for Failure to State a Claim. For all of the foregoing reasons, IT IS ORDERED that defendant's motion to dismiss is GRANTED IN PART and that Emperador-Baker's cla ims under Louisiana state law and her third and fourth "causes of action" are DISMISSED WITH PREJUDICE. In all other respects, the motion is DENIED. Plaintiff's claims remaining for trial at this time are her sex discrimination, hostile work environment and constructive discharge claims under Title VII, together with all requested remedies and relief.Signed by Magistrate Judge Joseph C.
