September 25, 2020 Opinion or Order Filing 5 ORDER - Plaintiff brought this civil action pursuant to 42 U.S.C. 1983, and he named the Terrebonne Parish Sheriffs Department as the sole defendant. However, that is improper, because "a sheriff's office is not a legal entity capable of being sued". Because plaintiff is proceeding pro se, the Court will afford him an opportunity to file an amended complaint. Accordingly, IT IS ORDERED that, on or before October 26, 2020, plaintiff file an amended complaint to name a proper defendant or defendants. Signed by Magistrate Judge Dana Douglas on 9/25/20.(cg)
