September 13, 2022 Opinion or Order Filing 11 ORDER - On August 26, 2022, the en banc court adopted Hurricane Ida CMO #1, creating a court supervised Streamlined Settlement Program ("SSP"). With respect to the currently pending Hurricane Ida cases that were previously filed, the CMO provides that the parties may opt-in to the SSP by agreement and with consent of the presiding District Judge. (Section 3-F). This Order, however, is intended to facilitate the parties in the previously-filed cases who want to opt-in to the Courts SSP program without the need for the parties in every case to sign and file opt-in forms. Accordingly, IT IS ORDERED that with respect to each of the above listed cases pending in Section "T", the parties will be presumed to agree to opt-in to the SSP, subject to the CMO #1, unless a party objects to participating in the SSP. Any such objection must be filed not later than fourteen (14) days from the date of this order, otherwise the Court will assume that all parties have agreed to opt-in. IT IS FURTHER ORDERED that the parties also acknowledge that, by opting into the SSP, the case will be stayed pursuant to the terms of CMO #1, and the stay will only be lifted pursuant to the terms contained therein.
