August 29, 2022 Opinion or Order Filing 5 ORDER: On August 24, 2022, Evaristo and Irene Rodriguez (collectively, "Plaintiffs"), filed a Complaint for Damages in this Court against Hartford Insurance Company of the Midwest. In the Complaint, Plaintiffs assert that this Court has subject matter jurisdiction based upon 28 U.S.C. 1332, diversity jurisdiction. The Complaint, however, fails to adequately allege the citizenship of the parties. While Plaintiffs adequately allege the citizenship of the Defendant, the Complaint contains no allegations regarding the citizenship of the Plaintiffs. Proper information regarding the citizenship of all parties is necessary to establish the Court's diversity jurisdiction. The Court, therefore, sua sponte raises the issue of whether it may exercise diversity jurisdiction in this matter. Accordingly, IT IS HEREBY ORDERED that plaintiffs, Evaristo Rodriguez and Irene Rodriguez, shall have seven (7) days from the date of this Order to file a comprehensive amended Complaint, without further leave of Court, properly setting forth the citizenship particulars of all of the parties, as required to establish that the Court has diversity jurisdiction over this case under 28 U.S.C. 1332(a). The comprehensive amended pleading shall include all of Plaintiffs' numbered allegations, as revised, supplemented, and/or amended, which will become the operative complaint in this matter without reference to any other document in the record.
