ORDER: On September 12, 2022, Carver Theater, LLC ("Carver") filed a Complaint in this Court against Seneca Specialty Insurance Company ("Seneca") based upon damages sustained as a result of Hurricane Ida. While Carver has sufficiently alleged its own citizenship in the Complaint,3 it has failed to adequately allege the citizenship of Seneca, as there is no allegation regarding what form of entity Seneca is. Thus, although Carver has alleged that Seneca is "an insurance company incorporated and domiciled in the State of Delaware with its principal place of business in New York, New York" it is unclear to the Court whether these allegations are sufficient because there is no allegation that Seneca is a corporation. IT IS HEREBY ORDERED that plaintiff, Carver Theater, LLC, shall have seven (7) days from the date of this Order to file a comprehensive amended complaint, without further leave of Court, properly setting forth the citizenship particulars of all of the parties, as required to establish that the Court has diversity jurisdiction over this case under 28 U.S.C. 1332(a).
