SHOW CAUSE ORDER: On September 26, 2022, this Court issued an Order requiring Plaintiffs to file an amended complaint to adequately allege the citizenship of the parties in order to establish the Court's diversity jurisdiction under 28 U.S.C. 1332(a). (R. Doc. 3). Pursuant to the Court's September 26th Order, Plaintiffs' deadline to file the amended complaint was October 3, 2022. As of the date of this Order, Plaintiffs have failed to file an amended complaint. Accordingly, IT IS HEREBY ORDERED that plaintiffs, Dylan Church and Katie Wing, shall appear telephonically at 2:00 p.m. (CST) on Wednesday, October 12, 2022 and show cause why they have failed to comply with the Court's September 26, 2022 Order, and why this matter should not be dismissed for lack of diversity jurisdiction under 28 U.S.C. 1332. ORDER: On September 23, 2022, Dylan Church and Katie Wing (collectively, "Plaintiffs") filed a Complaint in this Court against Allied Trust Insurance Company ("Allied") based upon damages sustained as a result of Hurricane Ida. In the Complaint, Plaintiffs assert that this Court has subject matter jurisdiction based upon 28 U.S.C. 1332(a)(1), diversity jurisdiction. While Plaintiffs have sufficiently alleged their own citizenship in the Complaint, Plaintiffs failed to adequately allege the citizenship of Allied. Accordingly, IT IS HEREBY ORDERED that plaintiffs, Dylan Church and Katie Wing, shall have seven (7) days from the date of this Order to file a comprehensive amended complaint, without further leave of Court, properly setting forth the citizenship particulars of all of the parties, as required to establish that the Court has diversity jurisdiction over this case under 28 U.S.C. 1332(a).
