October 25, 2022 Opinion or Order Filing 4 ORDER - Plaintiff filed the instant civil complaint in September of 2022, naming the Louisiana Supreme Court and the Louisiana Appellate Project as the defendants. The Clerk of Court thereafter issued a Notice of Deficient Filing, instructing plaintiff that he must (1) resubmit his complaint on the Court's approved form for complaints filed by prisoners seeking relief under 42 U.S.C. 1983 and (2) either pay the required filing fee or submit an application to proceed as a pauper. If plaintiff pays the filing fee or if someone pays it on his behalf, the filing fee will not be refunded it is the cost of filing suit and is due on filing. Again, however, neither that fee nor any portion thereof will be refunded to him by the Court even if this case is subsequently dismissed. Accordingly, the Court will give plaintiff additional time to consider his options. If he wishes to pursue this matter, then he (or someone on his behalf) must pay the nonrefundable filing fee of $402.00 on or before November 23, 2022. Alternatively, he may instead submit an application to proceed as a pauper by that same date. However, if the Court has not received either the full, nonrefundable filing fee or a pauper application by November 23, 2022, then a report will be issued recommending that this matter be dismissed for failure to prosecute.
