RULING Adopting 16 Report and Recommendations of the U.S. Magistrate Judge. 9 Motion for Summary Judgment, filed by Robert Chaterlain, Brandon Brown, Michael Vaughn, is granted and 10 Motion for Summary Judgment filed by Paul Howard, Sr., Richa rd Loyd, Paul Howard, Jr. is denied. Further the parties shall submit, within ten days, a person to serve as the impartial umpire, or failing to do so, the plaintiff group and the defendant group each will be permitted to recommend to the Court up to three persons who are willing to serve as the impartial umpire. It is the recommendation of th e magistrate judge that the Motion for Summary Judgment on Behalf of Employer Trustees of the Sheet Metal Workers International Association, Local Union No. 21, Welfare Trust Fund be granted, and the dfts' Motion for Summary Judgment be denied. If this recommendation is approved, then it is further recommended that the parties be given ten days from the ruling on these motions to agree on a person to serve as the impartial umpire, or failing to do so, the plaintiff group and the defendant group each be permitted to recommend to the Court up to three persons who are willing to serve as the impartial umpire.
