RULING in accordance with this Court's decision to abstain from deciding the merits of this case, Movers' motion to dismiss 14 is hereby GRANTED. FURTHER ORDERED that the Court defers ruling on the pending partial motion for summary judg ment to allow the state court to resolve such issues 15 . FURTHER ORDERED that the clerk dismiss this suit without prejudice to the rights of the parties in the state court action. Judgment shall be entered accordingly. Signed by Judge Brian A.
