Filing 27 RULING: Plaintiff's claims asserted against defendant J. S. Thompson be dismissed for failure of the plaintiff to serve this defendant within 120 days as mandated by Fed.R.Civ.P. 4(m). The Court declines to exercise supplemental jurisdiction. Th e defendants' Motion to Dismiss be and it is hereby GRANTED, dismissing the plaintiff's claims asserted against the remaining defendants, and this action be dismissed, with prejudice, but without prejudice to any state law claims which the plaintiff may have.
