RULING AND ORDER granting in part and denying in part 10 Motion for Summary Judgment. Plaintiffs claims under Title VII, the FMLA, and La. R.S. 23:342(2)(b) are DISMISSED WITH PREJUDICE. Plaintiffs La. R.S. 23:342(4) claim is DISMISSED WITHOUT PR EJUDICE and that this matter is REMANDED for consideration by the Nineteenth Judicial District Court, Parish of East Baton Rouge, State of Louisiana.
