RULING: The Court finds that the Defendants are prejudiced by the updated HAAG report of February 25, 2015 and both Smith affidavits. The updated report and both of the affidavits by HAAG engineer Steven R. Smith delve into new materials and form ne w opinions and conclusions and were not revealed until after the deadline for the Defendants to identify experts and produce expert reports. Plaintiffs have failed to demonstrate that the late disclosure of proposed experts, Steven R. Smith, P.E. and David L. Teasdale, P.E. and the late report and Affidavits of Steven R. Smith were substantially justified. The Court denies the Defendants Daubert challenge to the opinions of Kevin R. Davis as reflected in the "preliminary" HAAG report.
