Filing 41 RULING AND ORDER denying 17 Motion to Refer to the Bankruptcy Court Pursuant to 28 U.S.C. § 157 and LR83.4.1 The 18 Motion to Dismiss for Failure to State a Claim is GRANTED and all claims by Plaintiff against Federal Insurance Company are dismissed. The 21 Motion to Dismiss for Failure to State a Claim is GRANTED and all claims by Plaintiff against Navigators Specialty Insurance Company are dismissed. The 22 Motion to Dismiss for Failure to State a Claim is GRANTED IN PART AN D DENIED IN PART. Plaintiffs claims against Cannon (1) breach of the Service Agreement by negotiating and obtaining specific excess and aggregate excess workers compensation and employers liability reimbursement policies that violated Louisiana law, (2) for aiding and abetting a breach of fiduciary duty, and (3) for unjust enrichment are dismissed.
