RULING and ORDER: Sheriff Gautreaux's Motion to Dismiss (Doc. 9) is GRANTED, and Plaintiffs claims against him are DISMISSED WITHOUT PREJUDICE pursuant to Rule 12(b)(6). FURTHER ORDERED that Defendants' Motion to Dismiss (Doc. 19) is DENIED, prior service on Defendants is QUASHED, and Plaintiff is afforded 21 days to: (a) amend his complaint and (b) effectuate service of process consistent with this Ruling and Order. Plaintiffs amended complaint shall specifically identify the constitutional and statutory provisions that each defendant is alleged to have violated and the specific acts underlying said violations. FURTHER ORDERED that Plaintiff's claims against Defendant Gerrica Smith are DISMISSED WITHOUT PREJUDICES for failure to prosecute pursuant to LR 41(b)(l)(A). Signed by Chief Judge Brian A.
