OPINION: Based on the state court judgment, the bankruptcy court correctly concluded that Barranco was a fiduciary under federal law and that he committed acts of defalcation while acting in that capacity. Thus, the bankruptcy court also correctly found this debt to be non-dischargeable under Section 523(a)(4). Accordingly, the bankruptcy court's granting of summary judgment in favor of Plaintiffs-Appellees is AFFIRMED. Signed by Judge Shelly D. Dick on 10/24/2016. (LLH)
