If responses are not provided by that date, Attorney Battiste and Attorney Johnson shall confer directly on the telephone on or before July 14, 2020 in accordance with Rule 37(a)(1). Should the Court still be required to compel responses to this outstanding discovery, the non-prevailing party or attorney should be prepared to pay all fees and costs associated with the filing of such motion. Filing 50 RULING granting 39 Motion to Dismiss Second Supplemental and Amended Complaint. Plaintiff's claims against Chief Payne and the City of Plaquemine are dismissed with prejudice. The 40 Motion to Dismiss Second Supplemental and Amended Comp laint is GRANTED in part and DENIED in part. The Court denies the officers' motion to dismiss Plaintiff's Fourteenth Amendment due process claim as set forth herein. All other claims asserted against the officers are dismissed with prejudice.
