NOTICE AND ORDER: The #1 Notice of Removal, filed by Defendant Allied World Insurance Company ("Allied"), relies on records of Plaintiff Randall Bankston's past medical expenses to establish that the amount in controversy requirement is met (R. Doc. 1-6). Allied contends that the medical expenses arose out of an accident ("Accident") that occurred on December 1, 2017, which is the subject of Plaintiff's complaint in this matter (R. Doc. 1, paragraphs 1, 15). However, Plaintiff's state court Petition states that the Accident occurred on December 1, 2019 (R. Doc. 1-2, paragraph 2). It is thus unclear when the Accident occurred, and therefore, whether Allied has established that the amount in controversy requirement is met based upon the only evidence proffered by Allied, i.e., plaintiff's past medical expenses. Accordingly, by no later than July 22, 2020, the parties are ORDERED to confer by telephone to determine the date of the Accident and file a joint Notice with the Court confirming the date of the Accident.
