August 7, 2020 Opinion or Order Filing 8 ORDER denying #6 MOTION to Substitute Original Notice of Removal, filed by Haight Trucking, LLC, Roadmasters Power Transport, LLC, Hudson Insurance Company. The [6-2] proposed Amended Notice of Removal fails to properly plead the citizenship of Defendant Roadmasters Power Transport, LLC, as the listing of the individual members of Roadmasters Holdings, LLC in paragraph 17 fails to state where the individuals are domiciled. Merely listing a name, city, state and zip code, without an allegation as to domicile, is insufficient. The citizenship allegation as to Defendant Haight Trucking, LLC is also insufficient for the same reason. From paragraph 18, which states that Haight Trucking, LLC has a 50/50 ownership between Robert and Lori Haight of Hot Springs, Arkansas 71913, it is not clear that Arkansas is the Haights domicile, rather than residence. See The Courts Order at R. Doc. 5 explaining the necessary pleading requirements for a limited liability company. The denial is without prejudice to Defendants re-urging a proposed comprehensive amended Notice of Removal that contains all of Defendants numbered allegations (as revised, amended, and/or supplemented) and that properly alleges the citizenship of Defendants Roadmasters Power Transport, LLC and Haight Trucking LLC, by no later than August 11, 2020.
