ORDER denying without prejudice the #12 Motion for Leave to File Amended Complaint, filed by Plaintiffs Rebekah Etienne and Deondrick Brown, Sr., for failure to fully comply with the Courts previous #11 Notice and Order. While Plaintiffs attached a [12-1] proposed comprehensive complaint to their Motion, which adequately alleges the citizenship of Plaintiffs, and Defendant Abbott Laboratories, Inc., the allegations as to Defendant Mead Johnson & Company, LLC (Mead Johnson) remain deficient. Although Plaintiffs allege that Mead Johnson is a limited liability company whose sole member is Mead Johnson Nutrition Company, which has its principal business office at 225 North Canal Street, Chicago, Illinois, the Proposed Amended Complaint does not allege Mead Johnson Nutrition Companys place of incorporation, as required by 28 U.S.C. 1332(c)(1) (assuming Mead Johnson Nutrition Company is a corporation). Accordingly, on or before January 17, 2022, Plaintiffs shall file a motion for leave to amend their #1 Complaint, which attaches a proposed, comprehensive Amended Complaint that adequately alleges the citizenship of all parties, including Mead Johnsons sole member, Mead Johnson Nutrition Company.
