NOTICE AND ORDER: IT IS ORDERED that the #10 Motion for Leave to File an Amended Complaint, filed by Plaintiff Antoinette King in response to the Court's #7 Order, which is unopposed by Defendant Crown Plaza Hotel through Executive Hotel Management Inc., is GRANTED. Pursuant to Fed. R. Civ. P. 15, leave to amend shall be freely granted, and Plaintiff seeks to dismiss her claims against the nondiverse defendant Scott Michelet, originally mis-named in her Petition as Scott Mitchell. Upon dismissal of Michelet, the remaining parties are diverse and the amount in controversy requirement appears to be met. Accordingly, the Clerk of Court is instructed to docket Plaintiff's Amended Complaint for Damages at R. Doc. 10, pp. 3-7 into the record of this matter, which will become Plaintiffs operative Complaint, and to TERMINATE Scott Michelet, originally mis-named as "Scott Mitchell," as a defendant in this action.
