August 31, 2023 Opinion or Order Filing 4 NOTICE AND ORDER: Plaintiffs Stewart Francisco (individually and on behalf of his minor children, RF and SF, Jr.), Deadra Francisco, and Malachi Ridgely filed a #1 Complaint, alleging that this Court has subject matter jurisdiction under 28 U.S.C. 1332. Defendant Oxbow Calcining, LLC is alleged to be a "Delaware limited liability company whose principal place of business is located in the State of Florida." R. Doc. 1, para. 2. This allegation is insufficient to establish Defendants citizenship for diversity purposes. The citizenship of a limited liability company is determined by the citizenship of all its members, each of which must be specifically identified by name (and associated citizenship). Harvey v. Grey Wolf Drilling Co., 542 F.3d 1077, 1080 (5th Cir. 2008) and Nunez v. ACE Am. Ins. Co., No. 17-1593, 2017 WL 6997341, at *4 (M.D. La. Dec. 28, 2017). Accordingly, IT IS ORDERED that by no later than September 7, 2023, Plaintiff shall file a motion for leave to file an amended Complaint that properly alleges the citizenship of all parties. To avoid the risk of confusion, the proposed amended complaint should include all Plaintiff's numbered allegations, as revised, supplemented, and/or amended. If the motion for leave to amend is granted, the amended Complaint will become the operative Complaint in this matter without reference to any other document in the record. This case will be allowed to proceed if jurisdiction is adequately established, as citizenship has been adequately alleged for Plaintiffs, and the amount in controversy appears to be met.
