That same day, Defendants Allied World Assurance and Vantapro Specialty Insurance Company filed a #17 Motion for Leave to File Amended Notice of Removal, as previously ordered by the Court, to cure certain deficiencies in the original Notice of Removal. February 20, 2024 Opinion or Order Filing 18 ORDER: The #16 Plaintiffs' Motion for Leave to Amend and Restate Complaint, filed by Plaintiffs Louisiana Sports & Fitness Center No. 2, Inc. d/b/a Spectrum Fitness ("Spectrum Fitness") and D&D Partners, LLC d/b/a D&D Partnership ("D&D"), is DENIED WITHOUT PREJUDICE to re-urging as it is unclear. While the proposed [16-1] First Amended and Restated Complaint adequately alleges the citizenship of Plaintiffs Spectrum Fitness and D&D and of Defendants Vantapro Specialty Insurance Company and Allied World Insurance Company, the proposed Amended Complaint does not address the citizenship of Defendants Care Providers Insurance Services ("Care Providers") or Defendant Liberty Mutual Fire Insurance Company ("Liberty Mutual"). Although these entities are still listed in the caption of the proposed Amended Complaint, there are no factual assertions as to either of them in the body, so it is not clear whether Plaintiffs intend to pursue claims against these entities. Additionally, it is unclear whether Donnie Jarreau, individually, remains a plaintiff in this suit, as he is listed as a plaintiff in the caption, but not in paragraph 1 of the proposed Amended Complaint and the motion for leave was filed only on behalf of Spectrum Fitness and D&D. Any re-urged motion for leave must be filed by no later than March 1, 2024 and shall attach a comprehensive amended complaint that either: 1) removes any name from the caption for an individual or an entity who is no longer a party to this suit, or 2) identifies all parties in the caption, contains proper citizenship allegations for each party identified in the caption, and otherwise complies in all other respects with Fed. February 7, 2024 Opinion or Order Filing 14 ORDER: The #12 Plaintiffs' Motion for Leave to Amend and Restate Complaint, filed by Louisiana Sports & Fitness Center No. 2, Inc. d/b/a Spectrum Fitness ("Spectrum Fitness") and D&D Partners, LLC d/b/a D&D Partnership ("D&D"), is DENIED WITHOUT PREJUDICE to re-urging as it is deficient. The Court's subject matter jurisdiction in this case is alleged to be based on diversity of citizenship. The #8 January 9, 2024 Telephone Conference Report and Order required Plaintiffs to correct their names and to adequately state the citizenship of each entity. The January 9, 2024 Order also required Plaintiffs' counsel to include a certification that counsel has reviewed the Notice of Requirements for Diversity Jurisdiction, 28 U.S.C. 1332, and all cases cited in the Notice of Jurisdiction related to pleading citizenship of parties.
