Filing 2 ORDER: IT IS ORDERED that the 180 Complaint for Declaratory Judgment, filed by Plaintiff Billy Burkette, is SEVERED into a separate cause of action, bearing the title, Chief 2 Eagles, Chief of the Louisiana Band of Choctaw v. East Feliciana Parish Sheriff, et al., Civil Action No. 24-154-JWD-EWD. The case number for the new case will be sent to Plaintiff at his address of record as soon as a case number is assigned. Civil Action No. 18-996-JWD-EWD remains unchanged.IT IS FURTHER ORDERED that the Clerk of Court shall file the 180 Complaint for Declaratory Judgment, and a copy of this Order, into the newly opened case noted above. IT IS FURTHER ORDERED that Plaintiff Billy Burkette must either pay the $402.00 filing fee or file an application to proceed in forma pauperis in the newly opened case. IT IS FURTHER ORDERED that Plaintiff Billy Burkette shall cease filing motions and complaints seeking a declaration of tribal sovereignty in this action. Further filings seeking tribal recognition in this action may be stricken pursuant to Fed. R. Civ. P. 12(f). IT IS FURTHER ORDERED that the 181 Motion to Strike Complaint for Declaratory Judgment, filed by Defendants Jeffrey Travis and Greg Phares, and the 183 Motion to Strike Plaintiff's Complaint for Declaratory Judgment, filed by Secretary of State Nancy Landry, who has been substituted for Defendant Kyle Ardoin (R.
