Filing 10 ELECTRONIC ORDER. Petitioner filed a Petition for Habeas Corpus 2241 and Mandamus on January 29, 2021 (doc. 1). On February 2, 2021, he filed an amended petition and included a request for emergency/expedited relief (doc. 3). As neither document was filed on proper form, Petitioner was ordered to amend (doc. 6), which he did on February 10, 2021 (doc. 7). The petition currently in the record does not include a request for emergency or expedited relief. The Court finds that the deficient petition which requests emergency relief fails to state a compelling reason for same. As all deficiencies have now been cured, the Court will conduct a review of Petitioners claims, allowing the Respondent to answer, if necessary, and issue its ruling in due time. Accordingly, Petitioners Emergency Motion for Writ of Mandamus (doc. 3) is DENIED. Signed by Magistrate Judge Kathleen Kay on 2/17/2021. (jud,Kay, Kathleen) |
