ELECTRONIC ORDER denying #2 Motion to Appoint Counsel. There is no constitutional right to appointment of counsel in post-conviction proceedings. See United States v. Garcia, 689 F.3d 362, 36465 (5th Cir. 2012). Instead, a court may appoint counsel for a financially eligible person seeking relief under 28 U.S.C. 2241, 2254, or 2255 when it determines that the interests of justice so require. 18 U.S.C. 3006A(a)(2)(B). The Rules Governing 2254 Cases I the United States District Courts also permit appointment of counsel if a petition raises a substantial legal issue or if an evidentiary hearing is required.
