To the extent Defendants move to dismiss the claims against Vaughn and Guy in their official capacities, the motion is GRANTED, and Plaintiffs claims against them are DIS MISSED WITH PREJUDICE. To the extent Defendants move to dismiss the claims against Defendant City of Tallulah and against Vaughn and Guy in their individual capacities, the motion is DENIED. IT IS FURTHER ORDERED that Defendants implied Appeal of the Magistrate Judges Order allowing Plaintiff to amend his complaint, contained in Defendants objections [Doc. No. 63], is DENIED..
