Filing 51 MEMORANDUM RULING: For the foregoing reasons, the State Defendants' 34 Motion for Summary Judgment is GRANTED. State Defendants are entitled to sovereign immunity for "official capacity" claims and such claims by Leone are DISMISSE D WITHOUT PREJUDICE. All of Leone's remaining federal law claims lack sufficient summary judgment evidence and are DISMISSED WITH PREJUDICE. Because all of Leone's federal claims have been dismissed by this ruling, the Court declines to exe rcise supplemental jurisdiction over Leone's state law claims pursuant to 28 U.S.C. § 1367(3); therefore, Leone's state law claims are DISMISSED WITHOUT PREJUDICE.
