Filing 39 MEMORANDUM ORDER. 36 Order warned Mr Miller that failure to take one of two steps by November 10 could result in the entry of a default judgment against him. M S K was warned 36 Order that failure to retain new counsel by the deadline could resu lt in the entry of default judgment against it. The November 10, 2017 deadline has passed, and neither M S K nor Mr Miller have enrolled new counsel, requested an extension of time or taken any other action of record. Accordingly, 13 Answer filed by M S K and Mr Miller is stricken and the Clerk of Court is directed to enter a default against those two defendants. Plaintiff, if she wishes to pursue a judgment, is directed to file a motion for default judgment no later than 1 /13/2018. If plaintiff fails to take the steps required by this order, the complaint may be dismissed for failure to prosecute. If Plaintiff does not wish to pursue this matter, she should file a stipulation of dismissal or motion for voluntary dismissal.Signed by Magistrate Judge Mark L Hornsby on 11/16/2017.
