ELECTRONIC ORDER: Plaintiff's original complaint named defendants that included Nationwide. The court issued a memorandum order (Doc. #6 ) that directed Plaintiff to file an amended complaint and provide additional information about the citizenship of certain parties, including Nationwide. Between the preparation and filing of the memorandum order, Plaintiff filed an amended complaint that dropped Nationwide as a defendant. Accordingly, it is not mandatory that Plaintiff include information about Nationwide in the amended complaint ordered by the court (which will now require a motion for leave to amend, since the one free amendment allowed by Fed. R. Civ. Pro. 15(a) has been used). Even if Nationwide were nondiverse, Plaintiff could voluntarily dismiss a dispensable nondiverse defendant to create complete diversity of citizenship.
