MEMORANDUM RULING For the foregoing reasons, the Court finds in favor of plaintiffs on their claim for insurance proceeds, and finds in favor of the defendant on plaintiff's claim for statutory penalties. Pursuant to Fed. R. Civ. P. 54(d)(1), de fendant shall bear all court costs arising out of this proceeding. The parties are hereby ORDERED to jointly submit a final judgment, approved as to form, in accordance with the foregoing, within thirty days of issuance of this Ruling..
