IT IS ORDERED that the Motion to Dismiss filed by the DOC defendants, Michelle David, Tamyra Young, Melanie Benedict, Stayce Falgout and Dr Raman Singh, [Rec. Doc. 81], is GRANTED IN PART, in that Plaintiff's state law claims against the DOC defendants are DISMISSED WITHOUT PREJUDICE and Plantiff's § 1983 claims against the DOC defendants in their official capacities, with the exception of injunctive relief under the Ex Parte Young Doctrine, are DISMISSED WITH PREJUDICE; and DENIED IN PART as to Plaintiff's § 1983 claims against the DOC Defendants in their individual capacities under Rule 12(b)(6).
