Filing 165 MEMORANDUM OPINION AND ORDER granting in part and denying in part 144 Motion to Dismiss, 144 Motion for Qualified Immunity, which the Court has construed as a Motion for Summary Judgment; granting in part and denying in part 146 Motion for Summ ary Judgment. Granted as to the Dixons' federal law claims and denied as to the Dixons' state law claims. The following claims asserted by the Dixons against the School Defendants are dismissed with prejudice: violation of 42 U.S.C. Sec. 19 83, violation of 42 U.S.C. Sec. 1985, the right to substantive due process, the right to equal protection, and the Fourth Amendment; denying 155 Motion to Continue; finding as moot 162 Motion to Strike. Ordered that this lawsuit is remanded to the Circuit Court of Pearl River County, Mississippi. A certified copy of this order of remand shall be immediately mailed to the clerk of the state court.
