NOTICE of Settlement by All Parties as per telephonic status conference with attorneys Errol J. King, Jr. of the Phelps Dunbar Law Firm and Russell Stephen Gill. Counsel advised that the case has settled. The parties will file a Petition to Settle Plaintiffs' claim for reimbursement from a third-party settlement for benefits paid out of Plaintiffs' employee welfare benefit plan. The proceeds of the third-party settlement currently are being held in the trust account of attorney Russell Stephen Gill, as counsel for the Guardianship of E.M., a minor. After approval of the Petition to Settle, counsel will file a Motion to Remand the Guardianship back to state court for consideration of disbursement of the remaining funds held in Mr. Gill's trust account.
