TEXT ONLY ORDER granting Defendant Archie R. Mitchell's #48 Motion for Extension of Time to answer #1 Complaint and respond to #3 Motion for Preliminary Injunction and #4 Motion for Summary Judgment. While Plaintiffs oppose the #48 Motion, some of the statements made in their #52 Response are not completely accurate. See #52 Resp. For example, Plaintiffs cannot fault Mitchell for their own failure if they did not properly serve him the first time that service was attempted, and it is unclear how Mitchell's time to respond to the dispositive #3 , #4 Motions could be deemed to have expired prior to his deadline to file an answer. See id. at 2. Plaintiffs' allegations of prejudice are also unpersuasive, see id. at 2-3, particularly since Defendant Lynn Fitch has filed a #39 Motion for Judgment on the Pleadings which also raises Pullman abstention, and a separate Rule 56(d) #43 Motion, and Plaintiffs have not yet responded to either #39 , #43 Motion. Since the abstention issue must be resolved before the Court can address the merits of any of the claims advanced in this case, and because the Court finds that Defendant Archie R. Mitchell's #48 Motion for Extension of Time is otherwise well taken, it is granted.
