ORDER granting in part and denying in part Defendant David Huber's 27 Motion to Dismiss. Said motion is granted in part such that all 42 U.S.C. Section 1983 claims alleged by Plaintiff against Defendant Huber - with the exception of the excessive force claim - are dismissed with prejudice. The motion is denied in all other respects.
