ORDER granting Defendants Norfolk Southern Railway Company and The Alabama Great Southern Railway Company's 103 Motion for Summary Judgment; granting in part and denying in part Defendant Amtrak's 112 Motion for Partial Summary Judgment . Plaintiff's remaining claim against Defendants Norfolk Southern Railway Company and The Alabama Great Southern Railway Company is dismissed with prejudice. Additionally, the Joinder 109 filed on behalf of Defendant MDOT is granted and Plain tiff's remain claim against it is dismissed with prejudice. The Motion for Partial Summary Judgment filed on behalf of Defendants Amtrak, Wall, and Treadwell is granted in part and denied in part, such that any claim by Plaintiff that they had a general duty to operate the train at a slower speed unrelated to the presence of Plaintiff's automobile is dismissed with prejudice.
