The Court will grant the Motion t o Remand 3 if the Plaintiff files such an affidavit. Wal-Mart may serve its proposed Requests for Admissions [6-1] if the Plaintiff fails to file the aforementioned affidavit within the specified time period. Wal-Mart shall file Plaintiff's r esponses with the Court within seven days of its receipt of the responses.
