July 23, 2010	Filing 16 ORDER: Based on the record before the Court, Plaintiff's request for release from custody will not be construed as a petition for habeas corpus relief. Plaintiff's claims for monetary damages are barred by Heck v. Humphrey at this time and will be dismissed. This Court does not have authority to direct the Defendants to grant the relief petitioner seeks regarding his state court criminal records.
