ORDER granting 30 Motion for Summary Judgment for the reasons set out in the order. Because Markel's Motion did not appear to include dismissal of the bad-faith counterclaim, the opinion does not finally resolve the dispute, although as a pra ctical matter it resolves the issues. Accordingly, the parties are instructed to confer and collectively advise the Court by Friday, January 27, 2012 on the future handling of the matter.
