On January 18, 2013, Plaintiffs filed a "Voluntary Motion for Dismissal Wi thout Prejudice" 36 , in which they attempted to voluntarily dismiss all claims except for Poole and Millss FLSA and slander claims. Because both parties premised their positions on the now-vacated December 13, 2012 Order, the Court concludes that the motion should be denied without prejudice. The parties are directed to contact Magistrate Judge Ball within one week of this order to discuss the scope of remaining discovery and the possibility of reconsolidation.
