Filing 8 MEMORANDUM OPINION AND ORDER OF DISMISSAL, for reasons stated in this Order, the 42 U.S.C. § 1983 claims are hereby DISMISSED; the due process, ex post facto, and double jeopardy claims are dismissed WITH PREJUDICE as frivolous; and the equal p rotection and Eighth Amendment claims are dismissed WITHOUT PREJUDICE for failure to state a claim upon which relief could be granted. The dismissal of the § 1983 claims count as a strike pursuant to 28 U.S.C. § 1915(g). IT IS FURTHER ORDERED AND ADJUDGED that any remaining habeas claims are DISMISSED WITHOUT PREJUDICE.
